Terms of Service

1. Acceptance of Terms

By accessing or using EasySalon's platform, website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

EasySalon provides a cloud-based salon management platform that includes appointment scheduling, staff management, inventory tracking, customer relationship management, reporting and analytics, payroll tools, and payment processing integration through Clover POS.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use EasySalon, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years of age to create an account. You agree to notify us immediately of any unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that remain inactive for more than 12 months.

4. Pricing & Payment

EasySalon is offered at a per-salon and per-employee monthly rate as detailed on our Pricing page. All prices are in US dollars.

Payment is due at the beginning of each billing cycle. We accept payment via credit card, debit card, and ACH transfer processed through our payment partner.

Prices are subject to change with 30 days' written notice. If you do not agree to a price change, you may cancel your subscription before the change takes effect.

All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms.

5. Free Trial

We offer a free trial for new accounts. A valid credit card or payment method is required to start a trial. You will not be charged during the trial period. At the end of the trial period, your active payment method will automatically be charged for the subscription plan to continue using the Service unless you cancel prior to the end of the trial.

We reserve the right to modify or discontinue free trials at any time.

6. Your Data & Content

You retain ownership of all data, content, and information you input into EasySalon ("Your Content"). By using the Service, you grant us a limited license to use, process, and store Your Content solely to provide and improve the Service.

You are responsible for the accuracy and legality of Your Content. You represent that you have all necessary rights and consents to input customer data, employee information, and other data into the platform.

We will not access, use, or share Your Content for any purpose other than providing the Service, except as required by law or with your explicit consent.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to violate any laws • Transmit malware, viruses, or any destructive code • Attempt to gain unauthorized access to our systems or other users' accounts • Use the Service to send unsolicited communications (spam) to your clients • Reverse engineer, decompile, or disassemble any aspect of the Service • Resell, sublicense, or redistribute the Service without our written consent • Use the Service in a manner that could damage, disable, or impair our servers • Collect or harvest personal information of other users without consent

8. Intellectual Property

The Service, including all software, designs, text, graphics, logos, and other materials, is owned by EasySalon, Inc. and is protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without our prior written consent.

9. Third-Party Integrations

EasySalon integrates with third-party services including Clover POS, Google Calendar, and other platforms. Your use of these integrations is subject to the respective third party's terms of service and privacy policies.

We are not responsible for the functionality, availability, or security of third-party services. Integration availability may change without notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYSALON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Termination

You may cancel your subscription at any time through your account settings or by contacting support@easysalon.us. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your access to the Service if you violate these Terms, fail to pay fees, or engage in activities that harm our platform or other users.

Upon termination, you may request an export of Your Content within 30 days. After that period, we may delete Your Content.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved through binding arbitration in San Francisco, California, unless both parties agree otherwise.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
